Robin Burgess and Brianna Quinn prevail on summary judgment on immunity grounds for healthcare providers
Attorneys Robin Burgess and Brianna Quinn recently secured a defense judgment in a medical malpractice action during the initial phases of the lawsuit. Plaintiff claimed that the healthcare providers negligently relied on an inappropriate healthcare directive and, by following that directive, caused injury to the patient. Ms. Burgess and Ms. Quinn successfully argued that healthcare providers are entitled to immunity from civil liability when they acted in good faith to make medical decisions in reliance upon healthcare directives or directions provided by a surrogate. After extensive briefing and oral argument, the Court ruled that immunity applied and summary judgment was warranted for the client.
