Steve Sparks and Molly Podlesny Prevail in a Motion for Summary Judgment in an Insurance Bad Faith Case
Sanders & Parks Owner Steve Sparks and Associate Molly Podlesny recently prevailed on a Motion for Summary Judgment in an insurance bad faith case that was otherwise headed for trial. Mr. Sparks and Ms. Podlesny successfully argued to the Court that no reasonable jury could find that their insurance company client acted in bad faith in the handling of an underinsured motorist (UIM) claim. Specifically, there was no evidence that the insurance company engaged in any wrongdoing as it investigated and processed the claim. After oral argument, the presiding judge ruled in favor of Sanders & Parks’ insurance company client and granted summary judgment on all claims, finding that the dispute stemmed from a simple, good-faith disagreement over the value of the claim.
